This Green 360 Career Catalyst website was developed under a contract with Pacific Gas and Electric Company (“Funder”). The website is part of the Green 360® project and is supported by WestEd (“Developer”).

Acceptance of Terms

Please read the Terms of Use (“Terms”) carefully before using the Green 360 Career Catalyst website (“Site”). Using this Site indicates that users accept these Terms and the Privacy Policy. If users do not agree to these Terms, they should not use this Site. Users of this site include educators, students, members of community groups, parents, subject matter experts, and other Site visitors.

The developer may revise the information on this Site (including these Terms), improve and/or change the services provided on this Site, add new features, or terminate this Site without notice. If the developer changes these Terms, it will post an updated Terms of Use document on the Site showing the date of the current version.

Purpose of the Site

The Site is a curricular resource to guide students in middle school through college to make informed career choices and create their pathway to green careers. The Site provides a space for students to learn about their interests, the planet’s environmental challenges, and related occupations.

Registration

To use the Site, students are invited to register and create a user profile. Users are required to register to create a user profile and save their information. Users may log in to continue their career exploration at any time. Registration requires the following information: First Name, Last Name, Email, Password, Grade Level, School/Organization Name, City/Town of School/Organization, State of School/Organization, California County, Country, Role. Optional information requested includes Subject/Program Name and Instructor Name. Users may log in to edit their profile at any time.

User Portfolio

Registered users have access to a private user Portfolio that includes Interest Profiler results, saved jobs, a journal, and a Changemaker Statement.

Changemaker Wall

Users may ask to publish their Changemaker Statement on the Public Changemaker Wall on the Site. The statement captures their strengths, interests, goals, and selected Environmental Challenge(s). The statement includes their First Name only. Optionally, it may include the name of their School or Organization. Users may not include their Last Name in their statement or in the Nickname associated with the statement.

All statements submitted for publishing are reviewed for content and compliance with rules of spelling and grammar. Reviewers may make minor edits to statements only if such edits are, indeed, minor, and clarify their intent. Users will receive an email regarding the status of their submitted statement.

Users may edit their statement in their Portfolio. At any time, users may withdraw their statement from the public wall by logging in, visiting their Portfolio, editing their Changemaker Statement, and deselecting “Publish to Public Changemaker Wall on the Green360 Career Catalyst website.”

Intellectual Property

The Developer-provided content on this Site––including without limitation, any text*, graphics, and photos; and any trademarks, service marks, and logos contained therein (collectively, “Materials”)––is owned by or licensed to the Developer and the Funder and is subject to copyright, trademark, and other intellectual property rights.

All design rights, databases and compilations, and other intellectual property rights associated with this Site, in each case whether registered or unregistered, and related goodwill, are proprietary to the Developer.

Unless otherwise noted*, no Materials from this Site may be copied, reproduced, republished, uploaded, performed, distributed, displayed, posted, transmitted, or used to create a derivative work in any way without written permission of the rights owner. With written permission, users may use information purposely made available by the Developer for downloading from this Site, provided that they (1) keep intact all copyright and other proprietary notices, (2) use such information only for their proper informational purpose and do not copy or post such information on any other website or broadcast it in any media, (3) make no modifications to any such information, and (4) do not make any additional representations or warranties relating to such information. Users agree not to circumvent, disable, or otherwise interfere with any security-related features of this Site or features that prevent or restrict use or copying of any Materials or content.

Permission for all other uses of Materials contained herein must be obtained from the Developer, green360support “at” wested.org, otherwise, such use is prohibited.

*All lesson plans on the Site are licensed under a Creative Commons Attribution-NonCommercial 4.0 International License. Users may: (1) Share — copy and redistribute the material in any medium or format and (2) Adapt — remix, transform, and build upon the material.

Trademarks and Service Marks

Proprietary logos, service marks, and trademarks found on this Site are the property of the Developer or third parties. By making them available on this Site, neither the Developer nor their respective owner is granting users a license to use them in any fashion. Except as provided in these Terms, no trademark or service mark may be used as a hyperlink without the Developer’s prior written permission.

Other Prohibited Activities

In using the Career Catalyst Website, you agree not to:

  • Impersonate any person or misrepresent your identity or affiliation in any way;

  • Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others; use racially, ethnically, or otherwise offensive language; discuss or incite illegal activity; or use explicit/obscene language or solicit/post sexually explicit images (actual or simulated);

  • Intentionally seek information on, gain unauthorized access to, obtain copies of or modify files, other data belonging to other users without permission; or harvest user names, email addresses or other personal information for any purpose;

  • Promote information that you know to be false or misleading or that promotes or facilitates illegal activities, or conduct that is abusive, threatening, obscene, defamatory or libelous;

  • Gain unauthorized access to this Site or to other computers or websites connected or linked to this Site;

  • Violate any applicable laws or regulations or these Terms; or

  • Assist or permit any persons in engaging in any of the activities described above.

Privacy Policy

The Developer’s collection and use of personally identifiable information about users is subject to the Site’s Privacy Policy.

Links to Third-Party Websites

As users view this Site, they may notice links to third-party websites. These links are for convenience only. If users' use these links, they will leave this Site. Certain of these linked websites may make use of the Developer’s proprietary intellectual property rights under license from the Developer. The Developer makes no representations whatsoever about any website that users may access through this Site. The Developer is not responsible or liable for the content, advertising, products, services or other materials of these other websites or for any viruses or other damaging elements encountered in linking to a third-party website. In addition, providing links to these websites should not be interpreted as endorsement or approval by the Developer of the organizations sponsoring such third-party websites or their products or services. Disclaimer of Warranty

The Developer does not warrant or make any representation regarding the use, validity, accuracy, reliability of, or otherwise respecting the content available on this Site (or any other websites linked to or from this Site). Any material downloaded or otherwise obtained through this Site is done at the users' own discretion and risk. The content of this Site is provided “as is” and on an “as available” basis, without warranties of any kind either express or implied. To the fullest extent possible pursuant to applicable law, the Developer disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

Limitation of Liability

The Developer will not be liable for any damages of any kind arising out of or relating to the use or the inability to use this Site, its content or links, including but not limited to damages caused by or related to errors, omissions, interruptions, defects, delay in operation or transmission, or any computer virus or line failure. The Developer will also not be liable for any indirect, special, incidental, exemplary or consequential damages, even if the Developer has been advised of the possibility of such damages. Some jurisdictions do not allow exclusions or limitations of liability, so the foregoing limitations may not apply to users.

Indemnity

Users agree to indemnify, defend and hold the Developer and its directors, officers, employees, agents, and contractors, harmless from and against any and all claims, damages, losses, costs (including without limitation reasonable attorneys’ fees), or other expenses that arise directly or indirectly out of or from (i) users' breach of any provision of these Terms; (ii) users' activities in connection with this Site; or (iii) their User Content.

Termination

The Developer, in its sole discretion, may terminate or restrict users' use or access to this Site (or any part thereof) for any reason, including, without limitation, if the Developer believes users have violated or acted inconsistently with the letter or spirit of these Terms, or any other terms, conditions, or rules contained within this Site. The provisions of these Terms that by their nature contemplate performance after termination shall survive any such termination.

Jurisdictional Issues

The Developer makes no representation that the content on this Site is appropriate or available for use in other locations. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. Access to this Site from jurisdictions where the contents of this Site are illegal or penalized is prohibited.

General Information

By choosing to visit this Site or otherwise provide information to the Developer, users agree that any dispute over users' use of this Site, or these Terms will be governed by the laws of the State of California. Users also consent to the adjudication of any disputes arising in connection with our Site in the state and federal courts of San Francisco County in the State of California.

If any provision of these Terms is unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
